CYBER CRIME ACCORDING TO THE ITE LAW

Abstract

Advances in information technology in this region have the capacity to improve the quality of life of individuals. Furthermore, it has an impact on economic, religious, political and legal aspects, not only that. Therefore, internet technology also has a few negative impacts, although there are positive aspects. One of them is used as a tool in committing a criminal act which is usually called cybercrime or internet crime. The data in this research consists of documentation in the form of guidelines such as notes or quotations, searches of legal literature, books, etc. related to identifying offline and online problems. The content analysis method is used to analyze legal documents. This method requires careful examination of events or legal products to aid the interpretation of the analysis. Penalties for cybercrime in Indonesia are currently not clearly defined in the relevant legal regulations. Consideration of Criminal Code (KUHP) and non-KUHP factors is very important in determining the extent of global peace. It was a failure. Provisions in the Criminal Code that can be used to prosecute perpetrators of cyber crimes that have a broad interpretation are provisions regarding the crime of forgery (as regulated in Articles 263 to 276), the crime of theft (as regulated in Articles 362 to 367), the crime of theft (as regulated in in Articles 362 to 367), criminal acts of theft (as regulated in Articles 362 to 367), criminal acts of fraud (regulated in Articles 378 to 395), and criminal acts of damage to goods (as regulated in Articles 407 to 412). The basis for this analysis is the Electronic Information and Transaction Law no. 11 of 2008 (IET). The purpose of internal audit procedures is to discover and ascertain potential harm or violations committed by internet users. Proclamation Number 11 of 2008 concerning Electronic Information and Transactions promulgated by the United States on April 21 2008 made several changes. Based on investigations by the authorities, eight people have been arrested and are currently being detained for not complying with the provisions of the arrest warrant issued by the ITE Law
